Booking Terms

1.0 AGREEMENT

1.1 The booking terms and conditions of this document comprise the agreement between Pure Peaks Limited of 15 Belvedere Grove, London SW19 7RQ UK and all those listed on the booking form, on whose behalf the group leader has submitted. The contract is deemed to have been made as soon as the non-refundable deposit has been made (detailed in section 2.0) or full payment as applicable.

1.2 In these booking terms and conditions “we”, “our” or “us” are references to Pure Peaks and “you” and “your” are references to the named person on the booking and all the persons on whose behalf a booking is made.

The following other words and expressions shall have the following meanings:

“the group” or “guest” refers to all persons booked to stay in the accommodation listed on the booking form and also includes any subsequent changes of names to the original booking;

“party leader” means the person making the booking by submitting the booking form;

“holiday accommodation” refers to all accommodation offered at Pure Peaks currently listed as ‘The Nest, ‘Apartment Bellevue’ and ‘Apartment Corniche’;

“chalet” refers to all catered chalet accommodation at Pure Peaks only currently listed as ‘The Nest’ together with all meals, drinks and other services referred to in the website as being included in the the catered chalet’s  prices;

“website “ means “www.purepeaks.com

2.0 BOOKING AND DEPOSIT

2.1 Once availability of the holiday accommodation is confirmed by Pure Peaks, a non-refundable deposit of 25% is payable to confirm the booking. A booking will not be held until a full deposit is received, unless otherwise agreed by Pure Peaks. A completed booking form must be submitted within 7 days to complete a booking.

2.2 Should a booking be requested in writing/email or verbally, without payment of a deposit, the booking will be deemed not secure until Deposit monies are received. Thus, Pure Peaks reserves the right to re-book the same week in the same accommodation to another client without notification.

2.3 All bookings are secured with the non-refundable deposit and subsequent completed booking form, with full payment to be made no later than 10 weeks prior to arrival.

2.4 Bookings made within 10 weeks of arrival must be paid in full.

2.5 The first name entered on the booking form will deemed to be Group Leader thus he/she will be personally liable for all monies outstanding from the remainder of the guests.

3.0 PRICES

3.1 The prices stated within the website are per person for one week (7 nights) accommodation

3.2 Prices for catered accommodation only includes dinner and drinks on 6 nights and breakfast and afternoon tea on 7 days. On chalet staff’s night off guests are required to eat out and there is no provision of food or drink in the chalet. Guests are not permitted to access the Kitchen due to insurance reasons. Prices do not include flights or travel costs, airport transfers, holiday and medical insurance, ski pass, childcare, equipment hire, ski lessons and lunches.

3.2 Pure Peaks guarantees the price of the holiday as quoted at the time of booking and reserves the right to increase or decrease the price of unsold holidays at any time.

4.0 PAYMENT

4.1 The balance of your holiday will be due 10 weeks before departure. If the final balance is not received 10 weeks prior to the day the holiday commences we reserve the right to cancel the booking and any deposits paid will be forfeited. Pure Peaks then reserves the right to re-book the holiday accommodation without further notice.

4.2 Every effort will be made to contact the group to remind them of payment dates.

4.3 Preferred payment types are as follows: Bank Transfer and Paypal (any charge for which to be incurred by the client). Payments are made in pounds sterling though are available in euros upon request. Any fluctuations in currency must be absorbed by the client.

4.4 In the event of late payment of your final balance, any charges or loss of revenue incurred on our behalf will be added to your balance. We reserve the right to cancel your holiday should you fail to pay your final balance. No compensation will be provided.

5.0 CANCELLATION BY PURE PEAKS

5.1 Due to circumstances beyond Pure Peak’s control it may be necessary to make alterations to a confirmed booking or to cancel the booking completely. Whilst Pure Peaks will make every effort to ensure this does not happen, if it is unavoidable Pure Peaks will contact the Group Leader as soon as possible. In this instance Pure Peaks will endeavor to make alternative arrangements for accommodation (up to the same value) if available, offer an alternative holiday with Pure Peaks up to the same value or offer a full refund of any monies paid in relation to the booking. No other compensation will be offered.

5.2 Pure Peaks cannot accept responsibility or pay compensations where the performance of our contractual obligations is prevented by or affected by events amounting to Force Majeure. Force Majeure, meaning war, political unrest, weather, strikes, acts of God, epidemics, riots, civil strife, industrial disputes, terrorist activity, natural or technical disasters. Added to this, Pure Peaks cannot accept responsibility or pay compensations where the client defaults in the payment of the final balance of the holiday accommodation cost.

6.0 CANCELLATION BY CUSTOMER

6.1 You, or any member of your party, may cancel your holiday at any time providing that the cancellation is made by the person on the booking form in writing.

6.2 Pure Peaks takes no responsibility for non-delivery or non-receipt of the written cancellation.

6.3 The following charges apply when notification of the cancellation is:

More than 10 weeks before arrival – you are liable for the non-refundable deposit;

4 – 10 weeks before arrival- you are liable for 50% of the holiday cost;

Within 4 weeks of arrival – you are liable for 100% of the total holiday cost.

6.4 Non receipt of the balance of the cost of the holiday will not be taken as notification of cancellation; clients will still be liable for cancellation charges as shown above if they subsequently cancel the holiday.

7.0 LIMITATION OF LIABILITY

6.1 Pure Peaks does not accept any liability or pay compensation for any accident, personal injury or suffering arising for any reason either within the accommodation, during travel to and from the accommodation, or during activities with ourselves or by you. You are strongly advised to ensure that you are adequately insured both for personal injury and material loss/damage. All guests must accept full responsibility for any damage or loss caused by you or any member of your party. This includes the full payment for any such damage or loss, which must be made at the time to us or the third party concerned. If you fail to do so, you must indemnify us against any claims (including legal costs) subsequently made against us as a result of your actions.

8.0 WHOLE CHALET AND GROUP BOOKING

8.1 The self catered apartment(s) can be taken on a ‘whole chalet’ booking only

8.2 The catered chalet(s) may be taken on a whole chalet booking basis if requested

8.3 If for any reason part of the group cancels, the whole chalet booking price still stands and must be paid by the remaining client. If the client does not wish to pay the whole chalet price the chalet booking will be deemed cancelled and cancellation charges as set out in these terms and conditions will apply for the whole chalet. Pure Peaks then also reserves the right to re-sell the holiday without further notification.

8.4 Pure Peaks also reserves the right to have other parties stay in the chalet unless the whole chalet is taken or paid for.

9.0 RESPONSIBILITY AND BEHAVIOUR

9.1 All guests are expected to behave with consideration to other guests in order that everybody may enjoy their holiday. If in our reasonable opinion you or any member of your party behaves in such a way as to cause, or to be likely to cause, distress, danger or annoyance to any third party (including other guests) or damage to holiday accommodation, we reserve the right to terminate the holiday of the person concerned without notice.

9.2 All guests should act and behave in such a manner as to not affect or disrupt the enjoyment of other guests in any of the holiday accommodation, the local residents or have a negative effect on the reputation of Pure Peaks.

9.3 Under no circumstances are additional guests allowed to stay in the holiday accommodation other than those specified on the booking form. Failure to comply with this may result in your booking being terminated immediately in resort and you and your party being asked to vacate the relevant holiday accommodation immediately. No compensation will be paid for this.

9.5 The holiday of any guest that is in breach of the terms and conditions may have their holiday and Pure Peak‘s responsibility to them terminated immediately. In this extreme situation, our responsibilities towards that person (including any return transport arrangements) will immediately cease and we will not be responsible for meeting any costs or expenses they may incur as a result. In this extreme situation we will also not pay any compensation, or make any refunds to the individual involved, or to members of his/her party or associates that incur additional expense as a result of this action.

10.0 GUEST COMPLAINTS

Should you have any complaint with any part of your holiday you should complain immediately to the chalet staff. No complaints can be accepted for snow conditions, weather, closures of ski lifts and lack of ski companion services caused by injury, sickness or shortage of staff.

11.0 HOT TUB

11.1 Guests should adhere to the rules and regulations regarding the outside hot tub, a full description of these can be found in the Hot Tub safety notices posted within the Chalet. Pure Peaks presume that all guests, before using the hot tub, have read and understood these notices. Whilst Pure Peaks will endeavor to ensure the health and safety of guests using the hot tub, Pure Peaks cannot guarantee it.

11.2 We recommend that children under the age of 12 years of age do not use the hot tub. Children under the age of 16 years must be supervised by an adult at all times to avoid the risk of drowning and/or overheating. Adults allowing children to use the Hot Tub do so at their own risk.

11.3 Guests use hot tubs at their own risk and special care should be taken at all times, especially when getting into and out of the hot tub. Extra care should be taken during cold and icy conditions as the areas surrounding the hot tub cannot be salted to remove ice.
Pure Peaks presume that all guests, before using the hot tub, have read and understood the hot tub Safety notices posted within the chalet.

11.4 Pure Peaks reserves the right to carry out any maintenance and draining/ refilling needed that might render the hot tub unusable to ensure all health and safety regulations are met.

12.0 THIRD PARTY ACTIVITIES

12.1 Pure Peaks can assist in sourcing and booking many of the extra services you need when on a winter holiday, these services are subject to the terms and conditions of the individual companies and our help does not constitute an approval and we take no responsibility or liability for the service.

12.2 Any grievance with a third party service should be taken up with the provider and client directly.

13.0 FIRE PLACES

12.1 Care must be taken when using the fireplace. Naked flames and fire places are hot and can cause serious damage to property, belongings and people.Fireplaces should never be overloaded with wood, allowed to burn out of control and should never be left unattended. Clothes or other items should never be dried in front of them.

12.2 Pure Peaks accepts no responsibility for damage to guests, guest clothing or other property belonging to guests as a result of using the fire place.

12.3 If a guest damages Pure Peaks property as a result of using the fire place, they will be charged accordingly.

14.0 CHILDREN

13.1 No matter how much care is taken, our holiday accommodation is not childproof. Pure Peaks will not be held responsible for any accidents occurring within the holiday accommodation. It is the parents’ responsibility to ensure their children are supervised at all times.
Particular care must be taken with hot tubs, fire places and staircases as fire-guards and stair-gates are not provided.

13.2 Pure Peaks can provide high-chairs, travel-cots and car seats for infants and babies. However, Pure Peaks accept no responsibility should an accident or injury occur as a result of the use of such items. Parents assume full responsibility for the safety and wellbeing of their children at all times.

14.0 LOST AND STOLEN PROPERTY

13.1 In the event that guests lose or leave items in the chalet, no responsibility will be accepted if the property is not recovered or returned.

13.2 Pure Peaks cannot accept any responsibility for theft either from the chalet or at any other time during your holiday

3.3 Any client not properly securing the exits and windows after leaving the chalet will be liable to any property taken as a result of that negligence.

15.0 ARRIVAL/DEPARTURE TIMES

15.1 The holiday accommodation will be available to incoming guests after 3pm on day of arrival, although we will endeavour to have the chalet ready earlier only if previously requested for and agreed by Pure Peaks.

15.2 The chalet must be vacated on day of departure by 10am.

16.0 OUTDOOR SHOES AND EQUIPMENT

16.1 It is important that, for your comfort, a pair of slippers or indoor shoes are included in your packing as ALL outdoor shoes, which include ski/snowboard boots and mountain biking/cycling shoes, are strictly forbidden anywhere inside the holiday accommodation and communal areas.

16.2 All outdoor equipment, which includes but is not limited to mountain bikes, skis, snowboards, dirty, soiled or extremely wet clothing, must be stored in the designated area as provided by Pure Peaks on arrival. Please note slippers are provided at the chalet.

16.3 Under no circumstance is the repair, or maintenance and cleaning of such outdoor equipment allowed within the internal space of the property, including terraces, balconies and garden areas.

17.0 SMOKING

17.1 For health and safety reasons smoking is strictly prohibited within the holiday accommodation and Pure Peaks vehicles. If guests wish to smoke they must do so outside of these areas or within the designated smoking areas.

18.0 DIETARY REQUIREMENTS

19.1 Guests must inform Pure Peaks of any special dietary requirements before their holiday commences. This can be done via your My Booking form.

20.0 TRAVEL INSURANCE

20.1 Skiing, snowboarding and summer mountain activities can be dangerous pursuits both on and off piste, therefore you MUST be fully insured before partaking in a Pure Peaks holiday.

20.2 It is up to the Group Leader to ensure that each member of the group has all their own necessary medical and travel insurance documents to cover themselves, and their property/belongings fully before embarking on the holiday.

21.0 WEBSITE AND BROCHURE DESCRIPTIONS

20.1 We have taken great care in the printing & production of our website and accompanying literature but regret that we cannot be held responsible for circumstances outside of our control such as public holidays, religious festivals, maintenance work to, or breakdown of, lift systems, adverse weather conditions, nor guarantee the working of equipment such as televisions, telephones, etc. If any change becomes apparent which we believe will materially affect the enjoyment of your holiday then we will notify the party leader immediately it is brought to our attention and if within our control try and rectify the situation as quickly as possible.

22.0 TERMS OF CONTRACT

22.1 21.2 For the avoidance of doubt in the event of any conflict between the details on the Pure Peaks website and the T&Cs the provisions of the T&Cs prevail.

22.2 The contract is made on the terms of these booking conditions, governed by English Law. Both parties shall submit to the jurisdiction of English Courts at all times.
